North Lanarkshire Council (Disabled Persons' Parking Places) Order No 1 2012

The North Lanarkshire Council, in exercise of the powers conferred on them by Sections 4 and 6 of the Disabled Persons' Parking Places (Scotland) Act 2009 ("the Act"), the Road Traffic Regulation Act 1984 ("the 1984 Act") and of all other enabling powers and after consultation with the Chief Constable of Strathclyde Police, in accordance with Part III of Schedule 9 to the 1984 Act hereby makes the following Order:-

(1) This Order may be cited as "The North Lanarkshire Council (Disabled Persons' Parking Places) Order No 1 2012" and shall come into operation on Monday, the twelfth day of November, Two thousand and Twelve.

(2) Definitions

The following expressions have the meanings hereby assigned to them except where the context otherwise requires:-

"Council" means North Lanarkshire Council

"disabled person's badge" means:-

(a) a badge issued under Section 21 of the Chronically Sick and Disabled Persons Act 1970;

(b) a badge issued under a provision of the law of Northern Ireland corresponding to that Section, or

(c) a badge issued by any member State of the European Union other than the United Kingdom for purposes corresponding to the purposes for which badges under that Section are issued;

"disabled persons' parking place" means a parking place the use of which is restricted as provided in Section (3) of this Order;

"disabled person's vehicle" means a vehicle lawfully displaying a disabled persons' badge;

"parking place" means a place forming part of a road where a vehicle, or vehicles of any class, may wait, being a part of a road specified in the Schedule to this Order for which the use as a parking place has been authorised by the Council under Sections 32, 35, 36 and 37 of the Road Traffic Regulation Act 1984;

"road" means a road as defined in the Roads (Scotland) Act 1984;

"sign" means a traffic sign as defined in the Traffic Signs Regulations and General Directions, and

"vehicle" unless the context otherwise requires, means a vehicle of any description and includes a machine or implement of any kind drawn or propelled along roads whether or not by mechanical power.

(3) Parking Places for Disabled Persons' Vehicles

(a) Each area of road which is described in the Schedule to this Order is hereby designated as a parking place.

(b) The parking places designated in this Order shall only be used for the leaving of disabled persons' vehicles displaying a valid disabled person's badge.

(c) The limits of each parking place designated in this Order shall be indicated on the carriageway as prescribed by The Traffic Signs Regulations and General Directions 2002.

(d) Every vehicle left in any parking place designated in this Order shall so stand such that every part of the vehicle is within the limits of a parking place. Where the length of a vehicle precludes compliance with this paragraph, such vehicle shall be deemed to be within the limits of a parking place if;

(i) the extreme point of either the front or rear of the vehicle is no more than 300 millimetres outside the marked disabled persons' parking place, and

(ii) the vehicle, or any part thereof, is not within the limits of any adjoining disabled persons' parking place.

(e) A police officer or any person duly authorised by the Council, may, in the case of an emergency, instruct the owner/driver to move the vehicle to a safer place.

(f) Any person duly authorised by the Council may suspend or reserve the use of a parking place, or any part thereof, whenever and for such period as he or she may consider reasonable.

(g) A police officer in uniform may suspend, for not longer than twenty four hours, the use of a parking place or part thereof whenever such suspension is considered reasonably necessary for the purpose of facilitating the movement of traffic or promoting its safety.

(4) Penalties

Any person contravening or failing to comply with any of the provisions of this Order shall be guilty of an offence and liable, on summary conviction, to a fine not exceeding sixty pounds.
