Authorised council officeres have the power to serve notice on businesses or persons in control of land which they designate to be statutorily contaminated in terms of section 78B of the Environmental Protection Act 1990.
The authorised officers also have the power to serve notice on that business or person to require them to carry out such works to remediate the land in question.
