Notices served under section 80 of the Environmental Protection Act 1990

Authorised council officers have the power to serve a notice on a business or person who is found to be causing a nuisance in terms of section 80 of the Environmental Protection Act 1990.

The notice will require them to abate (stop) the nuisance by a certain date and may require them to prevent it from happening again. In some cases, if the person issued with the Notice does not do the required work the Council may carry out the work and take steps to recover the money. Where this happens the notice will stay on the register as being 'Extant' and with 'monies owed' until the money is paid back to the council.

Details of all section 80 notices served by Protective Services between 1 January 2019 and 1 March 2024 are shown below. Please note that colleagues in Built Environment also serve section 80 notices - the list below only includes those notices served by Protective Services and may therefore not be a complete list of all section 80 notices served by North Lanarkshire Council.
